CrimeaSOS: transfer of Enver Krosh and Vilen Temerianov to russia is a war crime

The transfer of citizen journalist Vilen Temerianov and activist Enver Krosh from Crimea to russian Rostov-on-Don is a war crime. This was reported by CrimeaSOS analyst Yevhenii Yaroshenko.

“Four Crimean Tatars, members of the “Dzhankoi group of the Hizb-ut-Tahrir case”, were escorted out of the Simferopol pre-trial detention centre to the russian city of Rostov-on-Don. This is an unlawful deportation and therefore a war crime: the unlawful deportation or transfer of a civilian (Article 8 (2)(a)(vii) of the Rome Statute of the International Criminal Court”, — says Yevhenii Yaroshenko.

Forcible displacement of the civilian population from the occupied territory, including prisoners, violates the international humanitarian law. Article 49 IV of the Geneva Convention prohibits the occupying power from forcibly transferring civilians from the occupied territory to the territory of the occupying power. Article 76 of this Convention stipulates that “persons accused of offences shall be detained in the occupied country, and if convicted they shall serve their sentences therein”.

According to Crimean Solidarity, four members of the “Dzhankoi group in the Hizb-ut-Tahrir case” were transferred to russia: Crimean Solidarity journalist Vilen Temerianov, activist Enver Krosh and two more Crimean Tatars: Rinat Aliev and Edem Bekirov. It happened three days ago.

Temerianov, Krosh and four more Crimean Tatars were detained on August 11, 2022 as a result of a wave of searches in the Dzhankoi area of the occupied Autonomous Republic of Crimea. They are suspected of involvement in the activities of a terrorist organization (article 205.5 of the criminal code of the russian federation) and preparation for a violent seizure of power in the russian federation (part 1 of article 30, article 278 of the criminal code of the russian federation).

We shall remind you that Ukrainian human rights defenders also see the threat of illegal deportation of Nariman Dzhelial and the Akhtemov brothers. According to available information, the illegally imprisoned Crimean political prisoners may be deported to russia.

Reference: “Hizb ut-Tahrir” is an international Islamic political party, which was recognized as a terrorist organization by the decision of the supreme court of the russian federation in 2003. However, it legally operates on the territory of Ukraine and most countries of the world. The occupiers sentence people for alleged involvement in “Hizb ut-Tahrir” up to 19 years in prison.
