CrimeaSOS: the detention of Dzhafer Abliamitov has elements of enforced disappearance

The detention of 65-year-old Kherson region resident Dzhafer Abliamitov contains signs of enforced disappearance. This was reported by CrimeaSOS analyst Yevhenii Yaroshenko. 

“The case of Dzhafer Abliamitov is a typical case when russian security forces in the occupied territories detain or abduct a person from their own home, after which their fate remains unknown for a long time. His detention has the elements of an enforced disappearance: deprivation of liberty against the will of the person concerned; involvement of state officials, at least indirectly, through tacit consent; refusal to acknowledge the fact of deprivation of liberty and to report the fate and whereabouts of the person concerned”, –Yevhenii Yaroshenko says.  

Dzhafer Abliamitov is a resident of the village of Novooleksiivka, Henichesk area, which is under russian occupation. On November 19, 2024, russian security forces broke into a man’s house, abducted him, and took him to an unknown destination. However, this became known only on December 11. His whereabouts still remain unknown. It is also important that the life of 65-year-old Dzhafer is at risk because he has chronic heart disease. 

It should be noted that during the first year of the full-scale war, CrimeaSOS managed to record 628 cases of enforced disappearances in the occupied part of the Kherson region. According to the organization’s calculations, during this time, 35 cases of enforced disappearances occurred in the territory of the Henichesk urban community, which includes the village of Novooleksiivka. That is, the Henichesk urban community is among the top five United Territorial Communities of the Kherson region in terms of the number of enforced disappearances.  

Despite the fact that the russian federation is not a State Party to the International Convention for the Protection of All Persons from Enforced Disappearance and the Rome Statute of the International Criminal Court, as a party to an international armed conflict, it is subject to the prohibition of enforced disappearance under customary international humanitarian law (rule 98) and a number of provisions of the International Covenant on Civil and Political Rights.
