CrimeaSOS: “judge” Fedeniova, convicted for deportation, can be prosecuted for other crimes

The so-called “judge” Tetiana Fedeniova who was convicted for the deportation of civilians from Crimea, can be prosecuted for other crimes. CrimeaSOS analyst Yevhenii Yaroshenko told about it.

“The so-called “judge” of the occupation “Armiansk City Court” in Crimea illegally imprisoned two Jehovah’s Witnesses: Oleksandr Dubovenko and Oleksandr Lytvyniuk. Therefore, she can be prosecuted for the war crime of illegal deprivation of liberty (Art. 8 (2)(a)(vii) Rome Statute of the International Criminal Court)”, — says Yevhenii Yaroshenko.

Having sentenced Jehovah’s Witnesses, Tetiana Fedeniova illegally applied the criminal legislation of the occupying state in the occupied territory, which violates Art. 43 of the Hague Regulations concerning the Laws and Customs of War on Land and Art. 64 IV of the Geneva Convention). In addition, such actions violate the right to freedom and personal integrity (Article 9 of the International Covenant on Civil and Political Rights, Article 5 of the European Convention on Human Rights) and the right to freedom of religion (Article 18 of the International Covenant on Civil and Political Rights, Article 9 of the European Convention on Human Rights).

On April 5, 2023, the Office of the Prosecutor General of Ukraine reported that for the first time in Ukraine, a sentence was passed for the deportation of the civilian population from Crimea. The so-called “judge” of the occupation “Armiansk City Court” in Crimea was sentenced in absentia to 10 years of imprisonment. She was found guilty of deporting a Crimean citizen from the territory of the temporarily occupied peninsula, which is a violation of the laws and customs of war (Article 438 of the Criminal Code of Ukraine) and a war crime in accordance with the provisions of international law.
