CrimeaSOS: those involved in the “nationalization” of property in Crimea can be prosecuted

3 / 02 / 2023

Those involved in the so-called “nationalization” of the property of Ukrainian citizens in the occupied Crimea can be brought to criminal liability at the international level. CrimeaSOS analyst Yevhenii Yaroshenko told us about it.

“The International Criminal Court (ICC) can bring those involved in the “nationalization” of property to individual criminal liability for a war crime committed on the occupied territory. If the occupiers “nationalized” the property by September 16, 2022*, victims can submit an individual complaint to the European Court of Human Rights (ECtHR) against russia regarding the violation of the “right to the peaceful enjoyment of possessions”, — said Yevhenii Yaroshenko.

On February 3, 2023, the occupying “parliament” in Crimea supported the so-called “nationalization” of the property of Ukrainian citizens on the territory of the peninsula. The list of “nationalization” includes approximately 500 objects of tourist, sports infrastructure, banks and various enterprises.

It is possible to submit a notice of information to the ICC regarding war crimes in Crimea in the form of “nationalization” of property. We shall remind you that according to the norms of international humanitarian law (in particular, the IV Geneva Convention relative to the Protection of Civilian Persons in Time of War, 1949), the seizure or destruction of the property of the opposite party, which is not justified by urgent military necessity, is a war crime.
