CrimeaSOS: implementation of two laws is necessary for the social protection of civilian hostages and the missing persons

In order to provide social protection and assistance to the families of civilian hostages and missing persons in the temporarily occupied territories of Ukraine, the implementation of two relevant laws and the creation of Unified registers are critically needed. CrimeaSOS lawyer Anastasiia Kalinina told about this during the press conference “What should the state do in 2023 to protect human rights in conditions of war”. 

“The number of civilian hostages is still unknown reliably, but in order to systematize the available information, it is critically necessary for the Unified Register of Prisoners and Captives to become operational”, — explained Anastasiia Kalinina.

To ensure social protection, it is necessary to implement the laws “On social and legal protection of persons who have been deprived of their personal freedom as a result of armed aggression against Ukraine, and members of their families” and “On the legal status of persons who have gone missing under special circumstances”.

The legislation of Ukraine regarding the missing persons under special circumstances does not work despite all the adopted laws. Thus, the state does not have a full-fledged system of social protection and support for the relatives of the missing persons.

“We do not have an effective implementation of the relevant law, we do not have an official register of missing persons, we do not have an effective search system, and as a result, the families of the missing persons cannot receive assistance from the state that they could rely on” — added the lawyer.

On February 9, the news agency “Ukraine Media Center Ukrinform” hosted a press conference “What should the state do in 2023 to protect human rights in conditions of war”. During the meeting, representatives of human rights NGOs presented their recommendations to the authorities.

Representatives of five NGOs that care of human rights in the occupied territories took part in the press conference. Among them was the CrimeaSOS lawyer Anastasiia Kalinina.
