2 / 02 / 2023CrimeaSOS “legal hotline” specialists received 2,253 appeals from people who suffered from russia’s aggression against Ukraine. This was reported by CrimeaSOS lawyer Anastasiia Kalinina.
“One of the most common questions to the CrimeaSOS “legal hotline” is establishing the legal fact of the birth of a child in the occupied territory. In 2022, CrimeaSOS lawyers submitted 243 applications to the courts to establish the fact of birth of children in the occupied Crimea and part of the Kherson region. Half of them have already received positive decisions”, — said Anastasiia Kalinina.
Currently, residents of the temporarily occupied territories can obtain documents confirming the facts of birth and death only through the court. The state is only developing the mechanism of the administrative procedure. In addition, residents of the temporarily occupied Kherson region, theoretically, after receiving a medical birth certificate, can apply to any body of registration of acts of civil status in the controlled territory to obtain a certificate. However, this applies only if the certificate issued by the hospital is of the state standard.
Recently, CrimeaSOS has published clarifications from lawyers on the most common problems of internally displaced persons (IDPs). Specialists explained the mechanisms of obtaining a certificate of IDP and residence allowance, registration of a Ukrainian pension, administrative services for residents of the occupied territories, establishing the fact of birth and departure to Ukraine through third countries.
