In Crimea activist fined for post in social network, dating from 2010

The defendant's lawyer called the case politically motivated, as an activist held actions in solidarity with the political prisoners of the Russian Federation, including in support of Oleksandr Kolchenko.

In Crimea in Simferopol railway court in the evening September 20 activist Oleksii Shestakovich was fined for 1000 rubles under Russian AK 20.29 "Production and distribution of extremist materials". It is reported by the Crimean Human Rights Group with reference to the defense lawyer of Shestakovich Oleksandr Popkov.

"Crimean was fined for that he posted video "The last video of the guys from Maritime Partisans" in the social network "VKontakte" in 2010 which was recognized in Russia as extremist material", — it is said on CHRG website.

The staff of the so-called Center "E" initiated administrative proceedings. On September 17 they stopped Shestakovich near his home because they thought he was intoxicated. They have issued reports on extremism, administrative detention and inspection.

On September 18 Shestakovich was officially invited for questioning to the Center "E", and already on September 20 the the trial was held. Officer of the Center "E" said at the trial that Oleksii Shestakovich was "involved in the radical left movement and placement on the walls of the city of stencil printing to boycott the elections".

Shestakovich called himself a "citizen of the world" answering the judge’s question about citizenship court. Crimean has only Ukrainian passport. He did not receive Russian passport.

Lawyer Oleksandr Popkov said that the case is politically motivated, as Shestakovich held actions in solidarity with the political prisoners of the Russian Federation, including in support of Crimean Oleksandr Kolchenko.

According to the lawyer, in the morning of the same day another court session was held where the court dismissed the appeal against the ban of activist to hold a picket near the building of the FSB. (Article 20.2. Russian AK. Violation of the order of organizing or holding meetings, rallies, demonstrations, marches and pickets.).

"The first trial is appeal upheld me a fine of 20 000 rubles for "not agreed" picket", — activist wrote in Facebook.

The picket was to take place on September 20. And Shestakovich filed a notice to authorities.

The lawyer also said the Crimean Human Rights Group that police and Procuracy  handed Shestakovich two warnings about the inadmissibility of extremist activities.

According to experts of the CHRG, the court, having made such a decision, violated paragraph 2 of Article 11 of the "Universal Declaration of Human Rights", Point 1, Article 7  f "European Convention on Human Rights", and Article 54 of the Constitution of the Russian Federation, as a person be held accountable for an act which was not recognized as an offense at the time of its commission.
