The Supreme Court of the Crimea found the actions of the FSB, which prohibited taking copies of the materials of the criminal case against Emir-Usein Kuku, illegal. Lawyer Oleksii Ladin informed this in a comment for QirimInfo.
The decision of the Crimean court states that such denial was illegal and the board of the Investigatory Department of the Administration of the Federal Security Service of Russia on the Crimea and Sevastopol should have abolished the corresponding resolutions.
«It was extremely impoirtant for the defense to take photographs exactly of the linguistic examination report, it was big, some 400 pages. We wanted it to be close at hand, to have an opportunity to analyze it», – the lawyer told.
The judge stressed that the investigator’s prohibition to make copies of the forensic examinations reports only after the preliminary investigation is finished contradicted the current criminal and procedural legislation.
Oleksii Ladin added that his colleague Andrii Sabinin «victoriously» made copies of the forensic examinations’ results.
Emir-Usein Kuku is a defendant in the Yalta «Hizb ut-Tahrir case» . Early this year, the investigation officially updated the charges against him under Article 278 of the Criminal Code of the Russian Federation «violent upheaval».
Previously, the investigation denied the defense to study the criminal case materials using the methods allowed by the law, namely, taking photos of the experts’ conclusions and study the subjects of the examinations. In connection with that, the lawyer complained to the court. The investigator also didn’t show the documents confirming the qualification and the working experience rate of the expert.
