Lawyer of citizen of Ukraine Yevgen Panov, who is introduced as Ukrainian "saboteur" by Russian security forces, received a certificate of refusal of his services from the FSB investigator, “Sobytija Kryma” reports. The lawyer was hired by family of Panov.
The investigator of the case of Panov gave a document to lawyer stating that the detainee allegedly had refused of legal assistance. At the same the certificate of refusal of the lawyer’s services presented to him, filed on behalf of the investigator and there are nor signature of Panov neither his handwriting, where he would write about his refusal. It is contrary to the norms of the Russian legislation, which is currently applied in Crimea. According to Part. 1, Art. 52 of Code of Criminal Procedure, denial of legal aid shall be permitted only on the initiative of the suspect and stated in writing.
The lawyer does not agree with such “refusal” and intends to appeal. Such actions of Russian law enforcement violate the rights of a detainee to a fair trial. In addition, they may indicate their intention to hide the consequences of illegal methods of influence on Panov during interrogations.
