Statement of PO CrimeaSOS regarding the searches and detentions of the Crimean Tatar activists

On May, 21, 2018 the houses of Server Mustafayev (Bakhchisaray, Stroitelnaya Str., 32) – the activist of the Crimean solidarity public association and Edem Smailov (Dolinoye village, Podgornaya str., 4A) – the activist, were searched by the Russian police in the Crimea, Center for Combating Extremism and the Federal Security Service.

The Russian media reported on the detention of members of the Hizb ut-Tahrir, organization banned in the Russian Federation, and the charges brought against them (Art. 205.5, part 2 of the Criminal Code of the Russian Federation – "Participation in the activities of a terrorist organization") even before the official announcement of charges.

Emil Kurbedinov, lawyer of S. Mustafayev, was not admitted to him during the search. A Volkswagen vehicle with the tinted license plate entered the courtyard of the searched house. After the search, Mustafayev was taken to the FSB Office in Simferopol.

As to the Edem Smailov’s situation, his three children were blocked in the house by the FSB officers. His wife was not permitted access to children. Lawyer Aider Azamatov, who came to E. Smailov, was not allowed to provide his client with the legal assistance.

Server Mustafayev and Edem Smailov are reportedly being included in the "Hizb ut-Tahrir case" of the second Bakhchisarai group, with the previously arrested Marlen Asanov, Seyran Saliev, Timur Ibrahimov, Server Zekeriayev, Memet Belyalov, and Ernest Ametov.

We demand from the authorities of the Russian Federation and the occupation authorities in the Crimea:

  •         to immediately release the Crimean Tatars Server Mustafayev and Edem Smailov;
  •         to conduct prompt, effective, and impartial investigation of unlawful detentions and physical violence committed against activists in the Crimea;
  •         to ensure that the perpetrators are brought to justice; to take all the necessary measures to prevent such attacks in the future;
  •         to release the detainees and stop the persecution of the Crimean Tatars, Crimean Muslims, including administrative arrests, criminal charges, confiscation of property and other repressions.
